Article Content

Article 1     These Standards are promulgated pursuant to Article 28 of the Taiwan Futures Exchange Corporation ("TAIFEX") Rules Governing the Use of Trading Information.
Article 2     Where a user applicant signs a Trading Information Usage Contract with the TAIFEX for the domestic dissemination and use of TAIFEX trading information, domestic trading information dissemination and usage fees and non-display usage fees shall be paid to the TAIFEX in accordance with the following provisions:
  1. Trading information dissemination and usage fees
    1. Fees for Ultra information:
      1. Telecommunications enterprises, information companies, Internet service providers, and Qualified Foreign Institutional Investors (QFII) applying for dissemination of trading information, regardless of whether through direct connection or indirect connection, shall pay fees as set out in Schedule 1.
      2. Futures commission merchants, futures introducing brokers, and special clearing members applying for dissemination of trading information through direct connection: NT$3,000 monthly per place of business.
      3. Futures commission merchants, futures introducing brokers, and special clearing members subscribing to use trading information: NT$1,000 monthly per place of business.
      4. News media institutions and radio/television enterprises applying for dissemination of trading information through direct connection: NT$40,000 monthly.
      5. News media institutions and radio/television enterprises subscribing to use trading information disseminated by other user applicants: NT$10,000 monthly.
    2. Fees for Core information: Fees for Core information shall be charged at a rate of 80 percent of the corresponding fee rate for Ultra information.
    3. A user applicant applying for dissemination of both Ultra and Core information needs only to pay fees for Ultra information.
  2. Non-display usage fees
    1. User applicants disseminate Ultra information to subscribers via leased lines: NT$10,000 monthly per subscriber.
    2. User applicants disseminate Ultra information to subscribers via the Internet: NT$500 monthly per subscriber.
    3. Futures proprietary merchants obtaining Ultra information via leased lines: NT$10,000 monthly.
  3. Domestic trading information dissemination and usage fees and non-display usage fees shall be calculated in units of one month and based on the monthly quantities reported by user applicants to the TAIFEX and partial months shall be calculated as full months.
  4. User applicants shall pay the first month's trading information dissemination and usage fee or non-display usage fee prior to the start of trading information dissemination or usage; at the end of each month, the TAIFEX shall send out the bill for the following month's fees and the user shall pay the bill by the 10th day of the following month.
  5. Where user applicants apply for dissemination and usage of trading information for the following purposes, fees may be reduced or waived with the approval of the TAIFEX:
    1. After-market information
    2. Public interest purposes
    3. Use in news reportage
  6. The content of trading information provided by the TAIFEX shall be limited to those dissemination items listed in Attachment 1 to the TAIFEX Rules Governing the Use of Trading Information. User applicants must pay additional fees for information other than those items listed.
  7. User applicants shall be solely liable for the costs of all relevant facilities installed for the trading information system; user applicants shall be solely responsible for the costs of distributors and data lines required for installation and for installation costs.
Article 2-1     Where a user applicant or licensed distribution user applies for Ultra information through direct connection, direct connection service fees and retransmission service fees shall be paid to the TAIFEX in accordance with the following provisions.
  1. Direct connection service fees: Free of charge for one principal and one backup connection per applicant user. Any additional direct connections shall be subject to the following fees:
    1. Futures commission merchants, futures introducing brokers, and special clearing members: NT$1,500 monthly per additional connection
    2. User applicants and licensed distribution users other than futures commission merchants, futures introducing brokers, and special clearing members: NT$2,000 monthly per additional connection.
  2. Retransmission service fees: For each leased line for the receipt of Ultra information, two retransmission sessions are free of charge for each trading system, with each additional retransmission session being subject to a fee of NT$2,000 monthly.
  3. Direct connection service fees and retransmission service fees shall be calculated in units of one month and partial months shall be calculated as full months.
  4. Article 2, subparagraph 4 applies with respect to the sending of bills by the TAIFEX and deadline for payment of fees by user applicants and licensed distribution users.
Article 3     Where a user applicant receives the TAIFEX's approval to transmit trading information overseas, user fees for overseas dissemination of trading information shall be paid in accordance with the following provisions:
  1. Rate: NT$600,000 annually.
  2. User fees for the overseas dissemination of trading information shall be calculated in units of one year; partial years shall be counted as full years and refunds may not be requested.
  3. User applicants shall pay the first year's trading information dissemination and usage fees prior to concluding a Trading Information User Agreement with the TAIFEX and fees for subsequent years shall be paid within 15 days prior to the expiration of the usage period.
Article 4     (Deleted)
Article 5     All fees payable in accordance with these Standards shall be paid by the deadlines for payment; where payment is late, the TAIFEX may impose a delay penalty of 1 percent of the overdue amount per day. Where payment still has not been made one month past the deadline, the TAIFEX may impose a breach penalty of NT$500,000 or terminate the user agreement.
Article 6     These Standards, and any amendments hereto, shall take force after ratification by the competent authority.
